Welcome to BlueMint RN LLC (\"BlueMint,\" \"we,\" \"our,\" or \"us\"). These Terms of Service (\"Terms\") govern your access to and use of the BlueMint platform, website, educational services, AI tools, tutoring services, and related features (collectively, the \"Services\").
By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Eligibility
To use BlueMint, you must be at least eighteen (18) years of age or have the permission and supervision of a parent or legal guardian.
By creating an account, you represent and warrant that all information you provide is accurate, complete, and current. You agree to maintain and promptly update your account information as necessary.
BlueMint reserves the right to refuse service, suspend accounts, or terminate access if false, misleading, fraudulent, or incomplete information is provided.
2. Account Registration & Security
You are responsible for maintaining the confidentiality and security of your account credentials.
You agree to:
- Keep your login credentials confidential.
- Notify BlueMint immediately of any unauthorized access to your account.
- Accept responsibility for all activity occurring under your account.
Sharing accounts, selling accounts, or allowing multiple individuals to use a single account is strictly prohibited unless expressly authorized by BlueMint.
BlueMint reserves the right to suspend or terminate accounts suspected of unauthorized sharing, fraudulent activity, misuse, or violations of these Terms.
3. Our Services
BlueMint is an educational technology company designed to support nursing students and healthcare learners through personalized education and learning tools.
Our Services may include, but are not limited to:
- One-on-one tutoring
- AI Coach
- Flashcards
- Test My Knowledge
- PDF study resources
- AI-assisted PDF learning
- Personalized study plans
- Educational messaging
- Performance analytics
- Educational videos
- Live coaching sessions
- Other educational tools and features introduced in the future
BlueMint continually improves its platform. As a result, Services may be modified, updated, enhanced, replaced, added, or discontinued at any time.
4. Educational Purpose
BlueMint exists solely for educational purposes.
BlueMint is not:
- A nursing school
- A college or university
- A healthcare provider
- A licensing board
- A provider of medical advice
BlueMint is an independent educational company and is not affiliated with, endorsed by, or sponsored by the National Council of State Boards of Nursing (NCSBN), the NCLEX examination, or any nursing school, college, university, healthcare institution, or licensing organization unless expressly stated.
5. User Responsibilities
By using BlueMint, you agree to use the Services responsibly and in accordance with these Terms.
You agree to:
- Use BlueMint solely for lawful educational purposes.
- Respect BlueMint staff, tutors, coaches, and other users.
- Provide accurate information when requested.
- Maintain the security of your account.
- Comply with all applicable local, state, and federal laws while using the Services.
You remain solely responsible for your own learning, decisions, actions, examination preparation, and use of any educational information provided through BlueMint.
6. Subscriptions & Payments
Certain BlueMint Services require payment through one-time purchases or recurring subscription plans.
By purchasing a tutoring session, coaching package, membership, subscription, or other paid Service, you agree to pay all applicable fees displayed at checkout.
Subscription plans may automatically renew unless canceled before the next billing cycle.
Failure to maintain a valid payment method may result in suspension or loss of access to subscription-based features.
BlueMint reserves the right to modify pricing, subscription plans, membership benefits, and available Services at any time. Any pricing changes will apply prospectively unless otherwise required by law.
Promotional discounts, coupons, and promotional offers are subject to their individual terms and conditions and may be modified, limited, suspended, or discontinued at BlueMint's sole discretion.
7. Tutoring Services
BlueMint provides one-on-one tutoring and educational coaching designed to improve nursing knowledge, clinical reasoning, and examination preparation.
Students are expected to attend scheduled sessions on time and actively participate throughout each tutoring session.
By booking tutoring services, you also agree to BlueMint's Refund & Cancellation Policy, which governs scheduling, attendance, cancellations, rescheduling, memberships, additional coaching hours, refunds, and other operational policies related to tutoring services.
8. AI Coach & Educational Tools
BlueMint provides AI-powered educational tools, including but not limited to AI Coach, Flashcards, Test My Knowledge, PDF learning tools, and other educational resources.
These tools are intended solely to support learning and examination preparation.
Although BlueMint strives to provide accurate educational content, AI-generated responses may occasionally contain inaccuracies, incomplete information, or outdated content.
Users should independently verify important clinical information using trusted educational resources, instructors, nursing textbooks, current clinical guidelines, and other reliable sources.
AI-generated responses are intended to supplement (not replace) independent study, instructor guidance, clinical education, professional judgment, or healthcare decision-making.
BlueMint's AI tools should never be relied upon as medical advice or used as a substitute for licensed healthcare professionals.
9. User-Generated Content
Certain BlueMint features allow users to create, upload, or store educational content, including, but not limited to, flashcards, notes, PDF files, assignments, and other study materials.
You retain ownership of the content you create.
By submitting or storing content on BlueMint, you grant BlueMint a limited, non-exclusive, royalty-free license to store, process, display, and use that content solely for operating, maintaining, securing, and improving the Services.
You remain solely responsible for all content you upload.
You agree not to upload, share, or distribute:
- Copyrighted materials without authorization.
- Illegal, harmful, fraudulent, or deceptive content.
- Content that infringes upon another person's intellectual property or privacy rights.
- Malicious software, viruses, or harmful code.
BlueMint reserves the right to remove content that violates these Terms or applicable law.
10. Intellectual Property
All software, educational materials, graphics, branding, logos, AI prompts, educational methods, study guides, flashcards, PDF resources, videos, website content, user interface designs, and other original materials made available through BlueMint are the exclusive property of BlueMint or its licensors unless otherwise stated.
This includes, but is not limited to:
- The BlueMint name and branding
- The BlueMint Method
- AI Coach
- Flashcards
- Test My Knowledge
- PDF study resources
- AI prompts and coaching workflows
- Original educational content
- Website design and user interface
Except as expressly permitted by BlueMint, you may not copy, reproduce, publish, distribute, modify, license, sell, or commercially exploit BlueMint content without prior written permission.
The BlueMint Method is an original educational framework developed by BlueMint. Unauthorized reproduction, commercial use, distribution, or representation of the BlueMint Method as your own is strictly prohibited.
11. Acceptable Use
By using BlueMint, you agree not to:
- Share your account with another individual.
- Sell, transfer, or sublicense your account.
- Copy or distribute BlueMint content without authorization.
- Upload copyrighted material without permission.
- Attempt to reverse engineer or compromise the platform.
- Use bots, scripts, or automated tools to scrape or access content.
- Attempt to bypass subscription restrictions, coaching-hour limitations, payment systems, promotional code restrictions, or other platform safeguards.
- Engage in unlawful, abusive, fraudulent, harmful, or disruptive conduct.
BlueMint reserves the right to investigate suspected violations and take appropriate action, including suspension or permanent termination of user accounts.
12. Suspension & Termination
BlueMint reserves the right to suspend, restrict, or permanently terminate access to the Services at its sole discretion if a user:
- Violates these Terms.
- Engages in fraudulent or unlawful activity.
- Shares accounts without authorization.
- Misuses BlueMint educational content or Services.
- Attempts to compromise the platform's security or integrity.
Termination does not relieve users of outstanding payment obligations or other responsibilities incurred before termination.
13. Disclaimer of Warranties
BlueMint provides its Services on an \"as is\" and \"as available\" basis.
Although we strive to provide accurate, reliable, and high-quality educational resources, we make no guarantees regarding the accuracy, completeness, reliability, availability, or uninterrupted operation of the Services.
Educational content, tutoring, AI-generated responses, study materials, and other resources are provided solely for educational purposes and should not be relied upon as medical, legal, or professional advice.
To the fullest extent permitted by law, BlueMint disclaims all express and implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of Liability
To the fullest extent permitted by applicable law, BlueMint, its owners, employees, contractors, tutors, affiliates, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising from the use of, or inability to use, the Services.
BlueMint's total liability for any claim arising out of or relating to the Services shall not exceed the total amount paid by the user to BlueMint during the twelve (12) months immediately preceding the event giving rise to the claim, to the maximum extent permitted by law.
Participation in tutoring, AI Coach, Flashcards, Test My Knowledge, PDF resources, educational coaching, and all other Services is voluntary and undertaken at the user's own discretion.
15. Changes to the Services
BlueMint continually improves its educational platform.
We reserve the right to modify, suspend, discontinue, replace, improve, or expand any feature, service, AI capability, educational tool, pricing structure, or platform functionality at any time.
Whenever reasonably practical, material changes affecting paid Services will apply prospectively.
